Do You Qualify For Record Sealing/Expungement Of A Conviction?

There have been several recent updates to Ohio’s laws for expungement or sealing a record of some convictions. You may qualify to have the heavy weight of certain convictions removed from public view of your record sooner than three years. You may apply for sealing a record of a misdemeanor, fourth-degree felony or fifth-degree felony one year after a conviction. The three-year waiting period still applies to convictions for third-degree felonies.

You may apply for sealing of records for up to four misdemeanors or a combination of two felonies and two misdemeanors. But not all applications for record sealing are successful. The judge bases final decisions on several factors including public interest. Convictions for violent or sex crimes are not eligible for record sealing, however exceptions may apply. The expungement process is complicated and best handled by an experienced criminal defense attorney. Speak with attorney Justin Kerr for help with not only determining whether you qualify to have your criminal record sealed, but also for assertive representation to pursue the most favorable outcome.
